Linehan v. Rockingham County Commissioners, 2003-826 (N.H. S.Ct., Nov. 16, 2004)

Duggan, J. The petitioner, J. Daniel Linehan, High Sheriff (sheriff), appeals a ruling of the Superior Court (Mangones, J.) granting in part and denying in part his petition for declaratory judgment and other equitable relief. We affirm.

Linehan v. Rockingham County Commissioners, 02-E-0508 (Hillsborough, North, Nov. 25, 2003)

J. Daniel Linehan, the Sheriff of Rockingham County ("the Sheriff"), brings a petition for declaratory judgment and equitable relief, asserting that the defendants, the Rockingham County Commissioners ("the Commissioners"), have impermissibly interfered with his constitutional, statutory and common law authority to administer the Rockingham County Sheriff's Department ("the Sheriff's Department"). Essentially, the Sheriff asserts that he is a constitutional officer, and, as such, he has exclusive authority to administer the Sheriff's Department, so long as he complies with the Sheriff's Department budget as adopted by the Rockingham County Convention ("the County Convention").
