DUGGAN, J. The petitioner, Deborah Beck, appeals a decree of the Rockingham County Probate Court (O’Neill, J.), which found that she is not entitled to a spousal share of the estate of David J. Bourassa. Beck argues that the trial court erred in failing to find that she was Bourassa’s common law spouse pursuant to RSA 457:39 (2004). Because the probate court reasonably held that Beck and Bourassa failed to acknowledge one another as husband and wife, as is required by RSA 457:39, we affirm.

HICKS, J. The respondent, Robert Martel, appeals from a final decree of divorce issued by the Portsmouth Family Division (Sadler, J.). The petitioner, Susan Martel, cross-appeals. We affirm in part, reverse in part, vacate in part and remand.

The main issues in dispute concern: (1) whether plaintiff is entitled to a divorce on the grounds of some form of marital "fault;" (2) whether certain property should properly be considered part of the marital estate; (3) the value of certain assets of the estate; (4) the manner in which the estate should be divided; and (5) the amount and duration of alimony plaintiff should receive. After briefly reciting the pertinent background facts, the court addresses these issues in turn below.
